Long-term home rental
A lease of a home used as the tenant’s permanent residence is an "arrendamiento de vivienda" under LAU art. 2, so all the housing rules below apply.

IRAV limit for contracts signed from 26 May 2023
Your contract was signed on or after 26 May 2023, so the update cannot exceed the IRAV published by INE (LAU 11th additional provision, added by Ley 12/2023). IRAV for August 2026: 2.47%.
Result
The contract index (4.30%) is higher than the legal limit, so the maximum is the limit: 2.47%.
Put it in writing
The new rent only becomes payable once the landlord notifies it in writing, stating the percentage applied. Fill in the names and the letter updates as you type.
How to send it so it counts. Use a method you can prove later: a burofax with certificate of content and acknowledgement of receipt (burofax con certificación de contenido y acuse de recibo) from Correos, or email if your contract allows notices by email. A landlord can also write the update on the previous month’s rent receipt (LAU art. 18.2). Send the Spanish version, or both — a Spanish court will read the Spanish.
IRAV and IPC, month by month
Since January 2025 the IRAV has capped rent updates on contracts signed from 26 May 2023. When inflation rises, the gap between the two lines is what the cap holds back.

Questions people ask
My contract says IPC. Can my landlord apply the full 4.3%?
Only if the contract was signed before 26 May 2023. For housing leases signed on or after that date, the update can never exceed the IRAV published by INE — 2.47% for August 2026 — even if the contract says IPC. That limit comes from the eleventh additional provision of the Urban Leases Law (LAU), added by the Housing Law, Ley 12/2023.
My contract has no update clause. Can the rent still go up?
No. Under LAU article 18.1, without an express agreement in the contract the rent is not updated during the contract. The landlord can propose a new rent when the contract (and its extensions) end, but not raise it mid-contract.
When does the new rent start?
From the month after the landlord notifies it in writing, stating the percentage applied (LAU article 18.2). If the notice arrives on 20 October, the new rent is payable from November. The landlord can also write the notice on the previous month’s rent receipt.
Which month’s index applies?
Normally the latest figure INE had published on the update date. INE publishes each month’s IPC and IRAV around the 12th–15th of the following month, so an update on 10 October 2026 uses August 2026. If your contract names a different month, choose it under “More options”.
What were the 2022–2024 limits?
Updates between 31 March 2022 and 31 December 2023 were capped at 2% (the IGC) by RDL 6/2022; a landlord who was not a large holder could exceed it only if the tenant agreed. Updates falling in 2024 were capped at 3% for everyone. Both caps applied to all housing leases, whatever the signing date.
What was RDL 8/2026?
An emergency decree that capped housing rent updates at 2% from 22 March 2026. Congress rejected it on 28 April 2026, so the cap no longer applies — but updates that fell inside that window keep the 2% limit, because effects produced while a decree is in force remain valid.
Does this apply to holiday lets, rooms or commercial premises?
No. Seasonal and temporary leases, room rentals and commercial leases follow what the contract says. The IRAV limit and the 2022–2026 caps apply only to leases of a home that is the tenant’s permanent residence.
